Salvadoran National Charged with Illegal Reentry After Deportation
A Salvadoran national has been charged with illegally reentering the United States after being deported. Geraldo Reyes Menjivar-Menjivar, 33, was indicted on one count of illegal reentry of a deported alien.
According to court documents, Menjivar-Menjivar was previously deported on November 7, 2014, and was later encountered by law enforcement in Chelsea on May 24, 2018. Menjivar-Menjivar was found to be unlawfully present in the United States at the time of the encounter.
Menjivar-Menjivar faces a sentence of no greater than two years in prison, one year of supervised release, a fine of $250,000, and will be subject to deportation upon completion of his sentence. Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and other statutory factors.
United States Attorney Andrew E. Lelling and Rebecca J. Adducci, Interim Field Office Director, Boston, U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations, made the announcement today. Assistant U.S. Attorney Kenneth G. Shine of Lelling’s Major Crimes Unit is prosecuting the case.
The details contained in the indictment are allegations. The defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
Menegar, the alleged perpetrator, has a history of deportation, which began in 2014. He will face the consequences of his actions in the court and may face deportation upon completion of his sentence.
