Defendant Indicted for Death of 20-Year-Old during Police Pursuit
Washington DC – A grand jury has indicted two Metropolitan Police officers, Terence Sutton and Andrew Zabavsky, in connection with the death of 20-year-old Karon Hylton-Brown during a police pursuit in October 2020.
According to the indictment, on October 23, 2020, Sutton, a 37-year-old officer, was driving a police vehicle in Northwest Washington when he pursued Hylton-Brown, who was operating a moped on a sidewalk. The pursuit continued for over 10 blocks before Hylton-Brown was struck by a civilian vehicle and suffered severe head trauma, resulting in his death on October 25, 2020.
The indictment alleges that Sutton caused Hylton-Brown’s death by driving the police vehicle in a manner that showed a conscious disregard for an extreme risk of death or serious bodily injury to the victim. Additionally, Sutton and Zabavsky, a 53-year-old lieutenant, are accused of conspiring and combining to hide the circumstances of the traffic crash from MPD officials.
“Police officers are sworn to uphold the law and ensure the safety of the community,” said Acting U.S. Attorney Channing D. Phillips. “But when a select few violate their oath by engaging in criminal conduct, they cannot do so with impunity and must be held accountable.”
Sutton has been charged with second-degree murder, a crime that carries a statutory maximum of 40 years in prison. He has also been charged with federal counts of conspiracy and obstruction of justice, which carry a statutory maximum of five and 20 years, respectively. Zabavsky faces federal charges of conspiracy and obstruction of justice.
The case is being investigated by the Criminal Investigation and Intelligence Unit of the U.S. Attorney’s Office for the District of Columbia and the FBI’s Washington Field Office. The Public Corruption and Civil Rights Section of the U.S. Attorney’s Office for the District of Columbia will prosecute the case.
