Devasko Dewayne Lewis, False Statements and Conspiracy, Georgia 2013

Georgia’s Devasko Dewayne Lewis, 34, of Lowndes County, has been hit with a federal indictment that includes charges of making false statements and conspiracy to continue operations after an out-of-service order.

The United States Attorney for the Middle District of Georgia, Michael J. Moore, revealed the charges against Lewis. The indictment came from a federal grand jury in Macon on May 16, 2013, naming Lewis for violations of Title 18 United States Code and Title 49 Code of Federal Regulations.

Lewis’s previous company, Lewis Trucking, had been subjected to an imminent hazard operations out-of-service order by the Department of Transportation in October 2008. Despite this, the indictment claims that Lewis continued to operate commercial motor vehicles under different names, evading the authorities.

If convicted, Lewis could face up to five years in prison, a fine of $250,000, and three years supervised release for the false statements charges. The conspiracy charge carries a maximum sentence of one year imprisonment, a fine of up to $25,000, or both, plus an additional one-year supervised release.

Assistant United States Attorney Robert D. McCullers is leading the prosecution in this case, which was investigated by the United States Department of Transportation’s Office of Inspector General and Federal Motor Carrier Safety Administration.

Defendants are presumed innocent until proven guilty, and inquiries regarding this case should be directed to Sue McKinney at (478) 621-2602.
