Defendant Faces Up to Two Years in Prison for Illegal Re-entry
PITTSBURGH – In a shocking case of repeated disregard for U.S. immigration laws, Valber Silva-Brito, a 26-year-old Brazilian national, has been indicted on a charge of illegal re-entry after deportation.
The indictment, brought forth by a federal grand jury in Pittsburgh, marks the fourth time Silva-Brito has been found to be in the country illegally. Despite being formally removed by U.S. Immigration and Customs Enforcement three times – on October 16, 2007, January 10, 2008, and September 16, 2010 – Silva-Brito was once again discovered in Pittsburgh on June 9, 2013.
According to the indictment, the law provides for a maximum total sentence of two years in prison, a fine of $250,000 or both. Under the Federal Sentencing Guidelines, the actual sentence imposed would be based upon the seriousness of the offense and the prior criminal history, if any, of the defendant.
Assistant United States Attorney Paul E. Hull is prosecuting this case on behalf of the government. The U.S. Immigration and Customs Enforcement’s Homeland Security Investigations conducted the investigation leading to the indictment in this case.
