A Minneapolis man has pleaded guilty to illegally possessing a firearm as a felon, announced United States Attorney Andrew M. Luger. Javier Juan Valtierra, 31, pleaded guilty to one count of possessing a firearm as a felon in U.S. District Court before Senior Judge Michael J. Davis.
According to the defendant’s guilty plea and court documents, on July 18, 2022, Valtierra possessed a Smith & Wesson, M&P Bodyguard 380, .380 caliber semi-automatic pistol. Officers of the Minneapolis Police Department were called to the scene of the vehicle following calls that Valtierra and another individual were unconscious inside the vehicle.
Upon arrival, officers found the firearm in Valtierra’s pocket. Additionally, officers found baggies of cocaine and methamphetamine on Valtierra and in the car. This discovery led to the charges against Valtierra, who has a prior felony conviction and is therefore prohibited from possessing a firearm.
The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Minneapolis Police Department. Assistant U.S. Attorney Kimberly A. Svendsen is prosecuting the case. A sentencing hearing has not yet been scheduled for Valtierra.
The guilty plea is a significant development in the case, as it acknowledges Valtierra’s wrongdoing and accepts responsibility for his actions. The possession of a firearm by a felon is a serious offense, and Valtierra’s plea demonstrates the commitment of law enforcement to holding individuals accountable for their crimes.
