Vitol Inc., Position Limit Violations, Texas 2024

HOUSTON, TX – Commodity trading giant Vitol, Inc. has been slapped with a $500,000 penalty by the Commodity Futures Trading Commission (CFTC) for exceeding federal position limits on crude oil and live cattle futures contracts. The CFTC order, issued August 14, 2024, marks the agency’s first enforcement action utilizing its authority to monitor aggregate positions across multiple exchanges.

The investigation revealed that Vitol, along with its affiliate Vitol SA, repeatedly exceeded speculative position limits in West Texas Intermediate (WTI) crude oil futures traded on the New York Mercantile Exchange (NYMEX) and ICE Futures Energy Division (IFED) during May and June of 2022. On multiple days – May 17th, 18th, June 15th, and 16th – the firm’s combined positions in financially-settled options and futures equivalents surpassed the federal limits, peaking at 7,484 contracts on May 17th, exceeding the 6,000 contract limit by 1,484 contracts.

The CFTC also found that on December 5, 2022, Vitol held 771 December 2022 CME Live Cattle Futures contracts, exceeding the 600-contract spot month speculative limit by 171 contracts. These violations stem from the CFTC’s regulations designed to prevent market manipulation by limiting the size of positions held by individual firms.

“Federal position limits provide an important prophylactic against manipulation,” stated Ian McGinley, Director of Enforcement at the CFTC. “Today’s action shows the CFTC will use its ability to look at positions on and across exchanges to enforce compliance and protect the integrity of the futures markets.”

In addition to the financial penalty, the order requires Vitol to cease and desist from further violations of the Commodity Exchange Act and related CFTC regulations. The case was led by CFTC staff members Trevor Kokal, Michael P. Geiser, Carrie Kennedy, K. Brent Tomer, Lenel Hickson, Jr., and Manal M. Sultan.
