A 24-year-old Wakpala man was sentenced to 16 months in custody for distributing a controlled substance, according to the United States Attorney’s Office.

Francis DuBray, 24, was sentenced on January 10, 2014, by U.S. District Judge Charles B. Kornmann. He will also serve 3 years of supervised release and pay a $100 special assessment to the Federal Crime Victims Fund.

DuBray was indicted by a federal grand jury on August 21, 2013. He pleaded guilty on November 18, 2013, to distributing marijuana to a confidential informant on two separate occasions.

On May 13, 2013, the informant used $600 to purchase 6.92 ounces of marijuana from DuBray. Another controlled buy occurred on June 11, 2013, when the informant used $850 in pre-recorded money to purchase 7.60 ounces of marijuana from DuBray.

The investigation was conducted by the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant U.S. Attorney Jay Miller prosecuted the case.

Following the sentencing, DuBray was immediately turned over to the custody of the U.S. Marshals Service.
