WHEELING, WEST VIRGINIA – David Mallicone, a 53-year-old man from Weirton, was arraigned today for the serious charge of illegal possession of firearms. The acting United States Attorney Betsy Steinfeld Jividen announced the arraignment.
The federal grand jury in Wheeling indicted Mallicone on April 4, 2017, on a single count of ‘Unlawful Possession of a Firearm.’ This follows his previous conviction for possession and conspiracy to possess with the intent to distribute and intent to distribute marijuana in United States District Court.
According to the charges, Mallicone was found in possession of three rifles, two revolvers, two pistols, and one shotgun. The alleged offense took place in January 2017 within Hancock County.
The penalties for this charge are severe, with a possible ten-year sentence and a fine of up to $250,000. The actual sentence will be determined by the seriousness of the offenses and any prior criminal history, as dictated by the Federal Sentencing Guidelines.
Assistant U.S. Attorney Stephen L. Vogrin is handling the prosecution for the government. The investigation into this case was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Weirton Police Department.
The indictment against Mallicone is merely an accusation, and he is presumed innocent until proven guilty.
