Ashley K. Whitaker, 49, of Syracuse, NY, has been sentenced to a staggering 54 months in prison for his deliberate deception concerning sex offender registry compliance. The court’s decision came after a thorough investigation by the United States Marshal Service and the U.S. Probation Office.
Whitaker had previously served a ten-year sentence for receiving sexually explicit images of an Oswego County minor, leading to his classification as a Level 2 sex offender in New York. Following his release, he was required to disclose all internet identifiers and accounts to his probation officer.
In a brazen attempt to evade accountability, Whitaker created and used an email account without disclosing it to the registry or U.S. Probation. Over a series of monthly reports, he falsely claimed compliance with his registration obligations.
Acting United States Attorney John A. Sarcone III emphasized the importance of sex offender registration and compliance with probation: ‘These guardrails are put in place to protect the public. When offenders fail to comply, we will hold them accountable,’ Sarcone stated.
Whitaker’s duplicity was not just a breach of his parole; it also violated the terms of his supervised release for the underlying sex offense. He was sentenced to an additional 24 months imprisonment and 10 years of supervised release following the false statement conviction.
Acting United States Marshal Christopher Amoia echoed Sarcone’s sentiments, emphasizing the U.S. Marshals Service’s commitment to protecting communities: ‘The protection of our most vulnerable populations remains one of our highest priorities. We will continue to dedicate resources to locating and apprehending sex offenders who attempt to evade accountability.’
