FARGO, April 29, 2013 – U.S. Attorney Timothy Q. Purdon announced that on April 29, 2013, Zev Boyd Rush, 33, of Devils Lake, N.D., was sentenced before U.S. District Judge Ralph R. Erickson on a charge of striking, beating and wounding.
According to court documents, Rush pleaded guilty on February 4, 2013, to assaulting the victim with a black metal collapsible baton, causing numerous contusions to the victim’s arms and leg. The incident occurred on October 26, 2010, on the Spirit Lake Indian Reservation.
Rush was sentenced to two months’ imprisonment and four months of electronic monitoring to be followed by one year of supervised release. He was also ordered to pay restitution in the amount of $1,355 and to pay a $10 special assessment to the Crime Victim’s Fund.
The case was investigated by the Federal Bureau of Investigation and the Bureau of Indian Affairs. Assistant U.S. Attorney Janice M. Morley prosecuted the case.
The sentencing is a result of the ongoing efforts to combat violent crime on Native American reservations. The FBI and the Bureau of Indian Affairs have been working together to investigate and prosecute such crimes.
As a result of the sentence, the community can feel safer knowing that the perpetrator of this violent crime will face the consequences of their actions.
