Daniel Kocan, 59, of Morgantown, West Virginia, is headed to federal prison for nearly nine years after admitting to flooding the streets with synthetic marijuana while laundering the illicit proceeds through his storefront. The grim sentence, handed down today in Clarksburg, marks the end of a two-year spree during which Kocan peddled so-called ‘spice,’ ‘K2,’ and ‘fake weed’ under the guise of an adult novelty shop.
Kocan operated Mid Nite Adult in Morgantown, where shelves stocked with labeled ‘incense’ masked a full-scale drug enterprise. The synthetic cannabinoids he sold are designer compounds engineered to mimic THC, the active ingredient in marijuana, but with unpredictable and often dangerous side effects. Despite federal crackdowns, Kocan continued distribution for nearly two years, exploiting legal loopholes until federal agents closed in.
In July 2016, Kocan pleaded guilty to one count of ‘Conspiracy to Distribute Synthetic Cannabinoids and Schedule I Controlled Substance Analogue’ and one count of ‘Engaging in a Monetary Transaction with Cash Derived from Specified Unlawful Activity.’ The charges reflect both the supply chain operation and the deliberate effort to clean drug money through his business.
The investigation was led by the Mon Metro Drug and Violent Crime Task Force, a HIDTA-funded initiative, alongside the Three Rivers Drug Task Force. Their probe peeled back layers of cash transactions and shell transactions tied to Mid Nite Adult, revealing a pattern of financial deception designed to evade detection.
Assistant U.S. Attorney Zelda E. Wesley prosecuted the case with a no-frills approach, emphasizing the public danger posed by unregulated synthetic drugs. ‘This wasn’t harmless product,’ she stated in court filings. ‘It’s poison sold as recreation, and the profits were just as toxic.’
U.S. District Judge John Preston Bailey imposed the full 108-month sentence, sending a hard message to operators of head shops skirting the edge of legality. Kocan must also forfeit assets tied to the operation. With synthetic drug networks still active across Appalachia, law enforcement vows this conviction is just one strike in a longer war.
