A Pioneer man is staring down federal charges after allegedly stealing firearms from a licensed dealer. Kyle Shirey, 34, was hit with a criminal information filing accusing him of theft of a firearm from a firearms dealer — a direct breach of federal law.
The charges, announced by Carole S. Rendon, U.S. Attorney for the Northern District of Ohio, also include receipt and possession of a firearm not registered with the Bureau of Alcohol, Tobacco, Firearms and Explosives. The violations carry stiff penalties, with potential prison time looming if Shirey is convicted.
Shirey’s fate will ultimately be decided by the court, which will weigh factors including his prior criminal record, if any, his role in the offense, and the nature of the violations. While the statutory maximum sets the upper limit for sentencing, most federal cases result in sentences below that threshold.
The Bureau of Alcohol, Tobacco, Firearms and Explosives in Toledo, Ohio, led the investigation. Federal authorities moved swiftly to secure the charges, underscoring the seriousness of firearm trafficking and illegal possession in the region.
Assistant United States Attorney Tracey Ballard Tangeman is prosecuting the case, building a case that will have to prove guilt beyond a reasonable doubt. Court documents offer no details yet on where or how the firearms were taken, or how many were involved.
A charge is not evidence of guilt. Kyle Shirey is presumed innocent until proven guilty in a court of law. The case remains active as federal prosecutors prepare for trial.
