Elvin Leonardo Oliva-Rodriguez, 37, a Honduran national, is facing federal charges after a routine traffic stop on Interstate 12 exposed a previous deportation. Border Patrol agents pulled him over traveling westbound when they discovered his illegal status, and a record showing he’d been kicked out of the US back in February 2014, following an arrest in McAllen, Texas.

The indictment, handed down March 13, 2026, accuses Oliva-Rodriguez of violating federal law against reentry of a removed alien – a charge carrying a potential two-year prison sentence. He was initially arrested during the I-12 stop and now awaits trial.

If convicted, Oliva-Rodriguez could also be slammed with up to a $250,000 fine, a year of supervised release, and a mandatory $100 assessment fee. Federal prosecutors, led by Assistant US Attorney Spiro G. Latsis, are handling the case.

US Attorney David I. Courcelle emphasized the indictment is just an accusation, and proof of guilt remains with the prosecution. The case falls under “Operation Take Back America,” a Justice Department initiative aimed at cracking down on illegal immigration and transnational criminal organizations. Courcelle’s office credited Customs and Enforcement Border Protection with the initial investigation.
