ALBANY, N.Y. — Brennan McNeil, 26, of Albany, New York, stood in federal court yesterday and admitted to producing child pornography — a grotesque crime involving the sexual exploitation of a 10-year-old child. McNeil entered a guilty plea that lays bare the chilling details of how he captured the abuse on video and carried the evidence across state lines.

The U.S. Attorney’s Office, led by Grant C. Jaquith, and FBI Albany Field Office Special Agent in Charge Vadim D. Thomas confirmed the plea. McNeil admitted that in early 2017, while living in North Carolina, he produced a video depicting a child as young as 10 engaged in sexually explicit conduct. That recording was stored on a thumb drive — a digital archive of abuse — which he brought with him when he moved to Albany in May 2017.

Arrested on June 21, 2017, McNeil has remained in federal custody ever since. He is now set to face sentencing on June 5, 2018, before Senior U.S. District Judge Thomas J. McAvoy. Prosecutors note he faces a mandatory minimum of 15 years and a maximum of 30 years in federal prison, up to a $250,000 fine, and a lifetime of supervised release. The judge will weigh the U.S. Sentencing Guidelines, the nature of the crime, and statutory mandates in determining the final sentence.

Upon any eventual release, McNeil will be required to register as a sex offender — a public designation that follows predators for life. The crime does not end behind bars; the digital footprint of such abuse persists, haunting victims and compromising their safety long after the files are seized.

The investigation was a joint operation between the FBI, the Colonie Police Department, and the New York State Police. Prosecution is being handled by Assistant U.S. Attorneys Joseph A. Giovannetti and Katherine Kopita, who emphasized the coordinated crackdown on child exploitation networks.

This case falls under Project Safe Childhood, a national initiative spearheaded by U.S. Attorneys to combat online child sexual abuse.
