Stilwell Man Gets Ten-Year Manslaughter Sentence

MUSKOGEE, OKLAHOMA – The grim tale of a fatal altercation reached its conclusion as Mose Adam Smith, 43, of Stilwell, Oklahoma, faced the full force of justice. Sentenced to 121 months in prison for Voluntary Manslaughter, Smith’s sentence will be followed by three years of Supervised Release.

The federal jury delivered its verdict on April 10, 2025, convicting Smith in the Eastern District of Oklahoma. The incident occurred on July 17, 2023, when Smith struck a victim during an altercation at the latter’s Sallisaw residence. Tragically, the victim succumbed to blunt force trauma and injuries from the fight.

In a chilling act of escape, Smith and co-defendant Kimberly Dawn Ball-Gilbert fled the scene in the victim’s truck. Their trail led them across state lines before they were apprehended by law enforcement ten days later in Illinois. The crime took place within the Cherokee Nation Reservation in Sequoyah County, part of the Eastern District of Oklahoma.

Ball-Gilbert, 42, of Stilwell, pleaded guilty to aiding and abetting Smith on March 19, 2025. Her sentencing has yet to be scheduled. Presenting the United States at the hearing was Assistant U.S. Attorneys Patrick M. Flanigan and Lewis M. Reagan.

Chief U.S. District Judge Ronald A. White oversaw the proceeding. Smith will remain in the custody of the U.S. Marshals Service until transported to a federal prison facility to serve his non-paroleable sentence. The case has served as a stark reminder of the consequences that follow violent crime.
