BUFFALO, N.Y. – Edin Julian Hernandez Mejia, 23, a citizen of Guatemala, is headed back to the country he fled after pleading guilty to the charge of re-entry of a removed alien. U.S. District Judge John L. Sinatra, Jr. handed down a three-month prison sentence today, a small price to pay for repeatedly violating U.S. immigration law.
According to Special Assistant U.S. Attorney Michael J. Smith, Hernandez Mejia has no legal standing in the United States. He was previously ejected from the country twice – in February and March of this year – only to reappear in Erie County, New York on August 5, 2025. Border Patrol agents apprehended him without any documentation authorizing his presence.
The case isn’t being framed as a simple immigration violation; it’s being touted as a victory in the larger, increasingly aggressive “Operation Take Back America.” The Department of Justice initiative aims to “repel the invasion of illegal immigration,” a phrase that reveals the administration’s harsh stance and rhetoric. The stated goal also includes the “total elimination of cartels and transnational criminal organizations (TCOs).”
While Hernandez Mejia’s individual case may not involve cartels, the DOJ is clearly using it to send a message: repeated attempts to circumvent immigration laws will be met with federal prosecution. After serving his three-month sentence, Hernandez Mejia will be turned over to Immigration and Customs Enforcement (ICE) for deportation proceedings. Expect a swift removal.
