New York – The grim tale surrounding the death of Woody Smith has reached a conclusion. In a scathing report released today, New York Attorney General Letitia James’ Office of Special Investigation (OSI) has cleared officers involved in Smith’s tragic demise.
The OSI determined that a prosecutor would not be able to prove beyond a reasonable doubt that the use of force by these officers caused Mr. Smith’s death on October 13, 2023. The report cited an extensive investigation involving police body-worn camera footage and interviews with civilian witnesses.
That fateful day, two Troy Police Department (TPD) officers were dispatched to a residence in Troy following reports of trespassing. What ensued was a struggle as officers attempted to take Mr. Smith into custody, resulting in the 46-year-old’s death. The medical examiner found no evidence of asphyxia and concluded that Smith died from drug intoxication and pre-existing health conditions.
Under New York law, police are permitted to use physical force when necessary during an arrest. In this case, OSI noted that there was cause for the officers to believe Mr. Smith had committed a crime. Yet, despite the struggle, OSI concluded that insufficient proof exists to link the officers’ actions directly to Smith’s death.
For those who knew and loved Woody Smith, the report comes as a hard pill to swallow. But according to OSI, the law dictates that without conclusive evidence of criminal intent on the part of the officers, no charges can be pursued.
