Austin’s Fire Department Embroiled in Racial Discrimination Scandal

A shocking new probe by the Justice Department has revealed that the City of Austin’s Fire Department engaged in a brazen scheme to discriminate against African-American and Hispanic applicants for entry-level firefighter positions in 2012. The scandal, which has rocked the city’s law enforcement community, has left many questioning the integrity of the department’s hiring practices.

According to investigators, the city used a written test that disproportionately eliminated African-Americans and Hispanics from the hiring process, and failed to prove that the test was job-related and consistent with business necessity. The probe also revealed that the city’s method of weighting the assessments and processing candidates in descending rank order had an adverse impact on individuals in these protected groups who passed the written test.

As part of the settlement, the City of Austin will no longer use the selection practices challenged by the Justice Department, and will develop a new, lawful selection procedure that complies with Title VII of the Civil Rights Act of 1964. The city will also pay $780,000 in back pay to entry-level firefighter applicants who were harmed by the 2012 hiring practice and are determined to be eligible for relief.

African-American and Hispanic applicants determined to be eligible for relief under the decree will be eligible for one of 30 priority appointments to an entry-level firefighter position with the AFD. To be eligible for priority hire relief, applicants must pass the new, lawful selection procedure and other lawful selection procedures. Those who are offered priority hire relief will also be eligible for retroactive seniority.

Acting Assistant Attorney General Jocelyn Samuels praised the city for its efforts to address the issues and ensure that effective, Title VII-compliant selection practices are put into place. The investigation into the AFD’s hiring practices was a joint effort between the Justice Department and the U.S. Equal Employment Opportunity Commission (EEOC). The proposed resolution was made possible in part through collaboration between the Justice Department and the San Antonio Field Office of the EEOC.

The scandal has left many in the city reeling, and has raised questions about the city’s commitment to diversity and inclusion. As the city works to rebuild its reputation, many are calling for greater accountability and transparency in the hiring process.
