Federal Indictment Handed Down in Monongalia County

A 40-year-old Morgantown man is facing serious charges after a federal indictment was handed down in Monongalia County. Brian Cutright, a resident of Morgantown, West Virginia, is accused of violating federal firearms laws.

According to the indictment, Cutright is charged with one count of ‘Unlawful Possession of Firearm’ and one count of ‘Possession of Unregistered Firearm.’ The alleged offenses took place in July 2018 in Monongalia County.

The indictment alleges that Cutright, who is prohibited from possessing firearms due to his use of controlled substances, was in possession of a .25 caliber pistol, a .45 caliber pistol, two .22 caliber rifles, a .40 S&W rifle, and two 12-gauge shotguns.

‘This case serves as a reminder of the importance of following federal firearms laws and the consequences of violating them,’ said U.S. Attorney Bill Powell. ‘We will continue to work tirelessly to ensure that those who break these laws are held accountable.’

Cutright faces up to 10 years in prison and a fine of up to $250,000 for each count. The actual sentence imposed will be determined by the Federal Sentencing Guidelines, taking into account the seriousness of the offenses and Cutright’s prior criminal history, if any.

The case is being prosecuted by Assistant U.S. Attorney Zelda E. Wesley on behalf of the government. The Bureau of Alcohol, Tobacco, Firearms and Explosives, the Greater Harrison Drug & Violent Crimes Task Force, and the Mon Metro Drug & Violent Crimes Task Force investigated the case.

It is essential to note that an indictment is merely an accusation. Brian Cutright is presumed innocent unless and until proven guilty in a court of law.
