Brittney Nicole Schmidt, Involuntary Manslaughter, Oklahoma 2018

Muskogee, Oklahoma – In a shocking turn of events, Brittney Nicole Schmidt, 28, pleaded guilty to Involuntary Manslaughter in Indian Country. The charges were brought against her under 18 United States Code Sections 1151, 1153, and 1112, punishable by imprisonment for a period of up to 8 years and/or a fine of up to $250,000.00, along with a special assessment fee in the amount of $100.00.

The Indictment alleged that on or about August 15, 2018, within the Eastern District of Oklahoma, in Indian Country, the defendant did unlawfully kill another human being while in the commission of an unlawful act not amounting to a felony, that is operating a motor vehicle under the influence of one or more intoxicating substances, contrary to 47 Oklahoma Statute Section 11-902, without due caution and circumspection and with a wanton and reckless disregard for human life, and knew and should have known that her conduct imperiled the lives of others.

The charges arose from an investigation by the Oklahoma Highway Patrol, the Colbert and Calera City Police Departments, and the Federal Bureau of Investigation. It is clear that Schmidt’s actions on that fateful day had devastating consequences, and the guilty plea is a significant step towards justice.

The Honorable Kimberly E. West, U.S. Magistrate Judge in the United States District Court for the Eastern District of Oklahoma, in Muskogee, accepted the plea and ordered the completion of a presentence investigation report.
