Buffalo Man Sentenced for Accessory to Clean Air Act Violation
BUFFALO, N.Y. – A Buffalo man was sentenced to one year of probation for his role in a Clean Air Act violation.
Henry Hawkins, 45, was convicted of being an accessory after the fact to a false statement under the Clean Air Act. Hawkins was employed by JMD Environmental, Inc. as an air sampling technician and a project monitor, and was certified by the New York State Department of Health to conduct asbestos project monitor and air sampling duties.
Between June 9, 2009, and January 11, 2010, Hawkins and his co-defendants conducted asbestos abatement activities at six buildings at the Kensington Towers Apartment Complex in Buffalo. However, Hawkins knowingly issued a satisfactory visual inspection of the boiler room at building B-2, despite being aware that all asbestos had not been removed.
This is the first defendant to be sentenced as part of the Kensington Towers asbestos abatement project. Several other defendants have been convicted, including co-defendants Ernest Johnson, Rai Johnson, Evan Harnden, Chris Coseglia, Brian Scott, Donald Grzebielucha, William Manuszewski, and Theodore Lehmann.
The investigation into the Kensington Towers asbestos abatement project was led by the U.S. Environmental Protection Agency – Criminal Investigation Division, the Federal Bureau of Investigation, the U.S. Department of Housing and Urban Development – Office of Inspector General, and the New York State Department of Environmental Conservation Police.
Hawkins’ sentence is a significant development in the ongoing investigation into the Kensington Towers asbestos abatement project. The remaining defendants will be sentenced by U.S. District Court Judge Richard J. Arcara.>
