California Man Guilty in $6.5M Prescription Drug Scam

A Corona, California man has pleaded guilty to his role in a large-scale prescription drug diversion scheme that netted over $6.5 million in illicit profits.

Vin Nguyen, 45, pleaded guilty in U.S. District Court in Cincinnati to one count of conspiracy to commit mail and wire fraud. According to court documents, Nguyen and his co-conspirators purchased prescription drugs, including HIV medications and anti-psychotic medications, from unlicensed and illegal sources in California and Florida.

The group then sold the drugs to other diverters without the required pedigree documents, which disclose the origin of the drugs. Nguyen and his co-conspirators sold over $6.5 million worth of diverted drugs.

Nguyen’s scheme involved using the name ‘Modern Medical’ to conceal his involvement in the drug sales. Modern Medical is a real California company that had no involvement in the drug sales.

Nguyen and his co-conspirators sold the prescription drugs to David Miller and his company, Minnesota Independent Cooperative (MIC), which sold the drugs to wholesale and retail customers throughout the United States.

Miller and MIC created fraudulent pedigree documents to cover up the illegitimate sources of the drugs. Yusef Yassin Gomez, the owner of B&Y Wholesale in Puerto Rico, pleaded guilty to conspiracy to distribute prescription drugs without a wholesale license for his role in the conspiracy.

The case is being investigated by the U.S. Food and Drug Administration’s Office of Criminal Investigations and the U.S. Postal Inspection Service. Assistant U.S. Attorneys Anne L. Porter and Christy Muncy of the Southern District of Ohio and Trial Attorney John W. Burke of the Civil Division’s Consumer Protection Branch are representing the United States in this case.
