Oklahoma authorities have announced that Carl Ray Smith, a 52-year-old man from Okmulgee, has been sentenced to 45 months in prison for engaging in abusive sexual contact with a child under the age of 12.

The United States Attorney’s Office for the Eastern District of Oklahoma led the prosecution, with Assistant United States Attorney Sarah McAmis representing the government. The charges stemmed from an investigation by the Henryetta Police Department, the Muscogee Creek Nation Lighthorse Police, and the Federal Bureau of Investigation.

According to the indictment, Smith knowingly engaged in and caused sexual contact with an Indian child under the age of 12 between May 1, 2019, and May 25, 2019, in the Eastern District of Oklahoma, in Indian Country. The indictment alleged that Smith, a non-Indian, committed the crime in Indian Country.

United States Attorney Brian J. Kuester praised the courage of the child who spoke out against Smith’s abuse. “A courageous child spoke out to describe acts the defendant committed that no child should have to experience and as a result this investigation began. Less than a year later the defendant has been sentenced to the Bureau of Prisons and will forever be required to account for his whereabouts by registering as a sex offender. This child’s courage began the process that made a community safer,” Kuester said.

The Honorable Ronald A. White, U.S. District Judge in the United States District Court for the Eastern District of Oklahoma, presided over the hearing. As part of his sentence, Smith must register as a convicted sex offender and participate in an approved sex offender treatment program.

Smith will begin serving his 45-month sentence immediately. His case serves as a reminder of the importance of protecting children from abuse and the efforts of law enforcement to bring perpetrators to justice.
