Washington D.C. – The Commodity Futures Trading Commission (CFTC) announced a significant reorganization of its Division of Enforcement on February 4, 2025, aimed at streamlining fraud investigations and prioritizing victim recovery. The move, spearheaded by Acting Chairman Caroline D. Pham, seeks to move away from what the agency terms “regulation by enforcement.”

The CFTC will consolidate previous task forces into two new units: the Complex Fraud Task Force and the Retail Fraud and General Enforcement Task Force. The Complex Fraud Task Force, led by Deputy Director Paul Hayeck, will handle investigations and litigation involving sophisticated fraud and market manipulation across all asset classes. The Retail Fraud and General Enforcement Task Force, under Deputy Director Charles Marvine, will concentrate on fraud targeting individual investors and general violations of the Commodity Exchange Act.

Acting Director of Enforcement Brian Young stated the realignment is intended to enhance the agency’s ability to pursue fraudsters and restore public confidence in market integrity. He emphasized the evolving tactics employed by those seeking to exploit market participants, and the need for a more focused and efficient enforcement program.

According to the CFTC, the restructuring is designed to better leverage staff expertise, improve resource allocation, and prevent overreach. The agency aims to ensure consistency, fairness, and due process in all enforcement matters. While no specific cases or penalties were announced with the reorganization, the CFTC highlighted its commitment to vigorously pursuing bad actors and protecting the American public.
