Dustin Sargent, Obstruction of Law Enforcement, Washington 2021

Washington — Dustin Sargent, a 30-year-old man from Kunkletown, Pennsylvania, has been slapped with three felony charges for his violent role in the Jan. 6, 2021, Capitol breach. Sargent’s actions, along with those of fellow rioters, caused chaos during a joint session of Congress.

Sargent is accused of obstruction of law enforcement during civil disorder, assaulting, resisting, or impeding officers, and obstruction of an official proceeding. He is also charged with entering and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted building or grounds, engaging in physical violence in a restricted building or grounds, disorderly or disruptive conduct in the Capitol grounds or buildings, act of physical violence in the Capitol grounds or buildings, parading or picketing in a Capitol building.

Arrested this morning at his Kunkletown residence, Sargent is scheduled to appear later today in the Middle District of Pennsylvania. Court documents reveal Sargent’s involvement in the riot, including entering the Capitol through a broken window and re-entering after changing attire.

Video footage shows Sargent engaging in physical altercations with police officers, shoving and grabbing them in an attempt to clear a path for other rioters. One exchange sees him being heard on camera boasting about forcing his way into the House Chamber, even though police did not allow entry.

In Facebook posts from December 2020, Sargent expressed frustration over the election results and discussed violent responses to perceived government injustices. In early January 2021, he spoke of potential violence against elected officials, stating, “People in the government may be publicly hung.”

The case is being handled by the U.S. Attorney’s Office for the District of Columbia and the DOJ National Security Division’s Counterterrorism Section. FBI agents from Philadelphia and Washington Field Offices worked with local law enforcement to identify and apprehend Sargent.
