David Lee Fail, Child Pornography, Louisiana 2023

LAFAYETTE, La. — A federal jury in Lafayette has convicted David Lee Fail, 43, a former Abbeville resident, on charges of transportation and possession of child pornography, according to Acting United States Attorney Alexander C. Van Hook.

Fail’s sordid activities came to light when he uploaded explicit images of prepubescent children to a cloud-based storage platform in 2021. The National Center for Missing and Exploited Children (NCMEC) was alerted, leading to an investigation that uncovered Fail’s previous convictions for similar crimes.

The Louisiana Bureau of Investigation and Homeland Security Investigations (HSI) agents discovered the online storage account linked to Fail, which contained over 150 images depicting child sexual abuse. The investigation revealed Fail’s relocation from Abbeville to Denver after he disabled the account.

Fail now faces a minimum sentence of 40 years for transportation of child pornography and 20 years for possession, plus a fine up to $250,000. Sentencing is scheduled for December 9, 2025.
