Corrupt Tax Advisor Gets 6 Months in Prison

CINCINNATI – A local man has been sentenced to six months in prison for corruptly endeavoring to obstruct and impede the due administration of the Internal Revenue Code.

Robert C. Welti, 52, of Ripley, Ohio, was sentenced in U.S. District Court for the Southern District of Ohio after pleading guilty to one count of corruptly endeavoring to obstruct and impede the due administration of the Internal Revenue Code.

U.S. District Court Senior Judge Sandra S. Beckwith handed down the sentence, which includes one year of supervised release and $5,000 in fines. The court also ordered Welti to serve six months in prison.

According to court documents, Welti, who represented Douglas and Donald Frichtl in an Internal Revenue Service (IRS) audit, attempted to obstruct the audit in April 2002 by preventing properly summonsed documents from being turned over to the IRS, preventing the Frichtls from responding to the auditors’ questions, proposing meritless and frivolous questions and arguments to the IRS auditors, and accusing the IRS auditors of engaging in a criminal racketeering conspiracy.

The case resulted from an investigation by the IRS, Criminal Investigation. IRS Special Agent Ankur Arora conducted the investigation. Tax Division attorneys Thomas Voracek and Rita Calvin prosecuted the case.

Tax Division Acting Assistant Attorney General John A. DiCicco and Carter M. Stewart, U.S. Attorney for the Southern District of Ohio, made the announcement. Welti’s actions were a clear attempt to deceive the IRS and evade taxes, and the court’s sentence reflects the severity of his crimes.

The sentencing of Welti serves as a reminder that corrupt tax practices will not be tolerated. The IRS and the Tax Division will continue to investigate and prosecute individuals who engage in such activities, and those who are found guilty will face the full force of the law.
