A shocking case of violence has come to light in Montana, where Creston Kindness, a 30-year-old resident of Fort Hall, Idaho, was sentenced to a term of 63 months in connection with his guilty plea to assault resulting in serious bodily injury. The crime occurred within the exterior boundaries of the Rocky Boy’s Indian Reservation.
The victim, who was shot in the leg with a .40 caliber Smith and Wesson handgun, was hospitalized for two nights. The bullet, which had mushroomed, was retrieved at the crime scene. According to Assistant U.S. Attorney Danna R. Jackson, Kindness became agitated when the victim did not tell him where his girlfriend was, leading to the violent outburst.
Kindness was apprehended by tribal law enforcement and found with the handgun in the bathroom. The firearm was subsequently forfeited as part of the sentence. In addition to the prison term, Kindness was also ordered to pay a special assessment of $100 and serve 3 years of supervised release.
The investigation into the crime was conducted by the Federal Bureau of Investigation. Because there is no parole in the federal system, Kindness will likely serve all of the time imposed by the court. However, he has the opportunity to earn a sentence reduction for good behavior, which will not exceed 15% of the overall sentence.
Kindness, who is an enrolled member of a federally-recognized tribe, was brought before Chief U.S. District Judge Dana L. Christensen in a federal court session in Great Falls on September 25, 2013. The victim’s life was forever changed by the brutal attack, and Kindness’s actions have had a profound impact on the community.
The case serves as a stark reminder of the devastating effects of violence and the importance of seeking help when dealing with personal issues. The Rocky Boy’s Indian Reservation is a close-knit community, and incidents like this can have far-reaching consequences.
