Daniel L. Maguire, III, Child Pornography Possession, South Carolina 2015

A Charleston man has been sentenced to 30 months in prison for his role in a child pornography case that was launched after an undercover FBI agent discovered a peer-to-peer software user in Charleston was sharing files of child pornography on the internet.

The agent was able to access the files and traced the Internet Protocol (IP) address to the home of Daniel L. Maguire, III, 71, of Charleston. A federal search warrant was executed at Maguire’s home, where agents seized two computers and an external hard drive. A forensic examination of the devices revealed thousands of still images and videos of child pornography, including images and videos of prepubescent minors engaging in sexually explicit conduct.

Maguire pleaded guilty to a charge of possession of child pornography, a violation of Title 18, United States Code, Section 2255A(a)(5)(B). Senior United States District Judge Sol Blatt, Jr. of Charleston sentenced Maguire to 30 months in prison, followed by a lifetime term of supervised release. He was also ordered to pay restitution in the amount of $8,000 and a mandatory $100 special assessment fee.

The case was investigated by agents of the Federal Bureau of Investigation. Assistant United States Attorney Dean H. Secor of the Charleston office handled the case.

This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse.

Maguire’s guilty plea and subsequent sentencing are a stark reminder of the dangers of child pornography and the importance of protecting our children from exploitation.
