Defendant Sentenced to 15 Months in Prison for Failing to Update Sex Offender Registration

ALBUQUERQUE – A 38-year-old man was sentenced to 15 months in prison for failing to update his sex offender registration, according to court records.

Daniel Roy Nard, of Albuquerque, N.M., was sentenced in federal court to 15 months in prison followed by five years of supervised release for violating the Sex Offender Registration and Notification Act (SORNA). Nard will be required to register as a sex offender when he completes his prison sentence.

Nard was charged by indictment on Dec. 17, 2015, with violating SORNA by failing to update his sex offender registration on Oct. 30, 2015, or thereafter. Nard was required to register as a sex offender and to maintain an updated registration based on a federal child pornography conviction in Montana in 2007.

According to the indictment, Nard was required to maintain an updated sex offender registration in Bernalillo County, N.M. On Jan. 9, 2017, Nard pled guilty to the indictment without the benefit of a plea agreement.

This case was investigated by the U.S. Marshals Service and the Bernalillo County Sheriff’s Office and was prosecuted by Assistant U.S. Attorney Jon K. Stanford. The U.S. Marshals Service and the Bernalillo County Sheriff’s Office worked together to ensure that Nard was held accountable for his crimes.

Nard’s sentence sends a strong message that failing to update sex offender registration is a serious crime that will be punished accordingly. The community can rest assured that law enforcement agencies are working tirelessly to protect them from individuals who fail to comply with the law.
