Daryl Eagle Horse Arrested for Failure to Appear in Federal Court
A 29-year-old Eagle Butte woman has been indicted by a federal grand jury for failing to appear in court. The indictment was announced by United States Attorney Randolph J. Seiler on November 8, 2016.
Daryl Eagle Horse, also known as Daryl Hawk Eagle, failed to appear in Federal District Court for further proceedings on November 1-2, 2016, after being released from custody on charges of Forgery and Larceny. The U.S. Marshals Service is leading the investigation into the case.
Eagle Horse was remanded to the custody of the U.S. Marshals Service pending trial. The maximum penalty for the Failure to Appear charge is up to 2 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The term of imprisonment imposed for the Failure to Appear charge must be consecutive to the sentence of imprisonment for the criminal offense for which she failed to appear in court. Eagle Horse has plead not guilty to the indictment and a trial date has not yet been set.
Assistant U.S. Attorney Jay Miller is prosecuting the case. The charge is merely an accusation, and Eagle Horse is presumed innocent until proven guilty in a court of law.
