Idaho Man Pleads Guilty to Conspiring to Obstruct Justice in Iowa
An Idaho man who conspired to obstruct justice has pleaded guilty in federal court in Cedar Rapids, Iowa. David Emerson Smith, from Pocatello, Idaho, was convicted of one count of conspiracy to obstruct, influence, and impede an official proceeding.
According to court documents, David Smith admitted that from June 2017 through 2018, he agreed with his brother, Darrell Smith, to obstruct, influence, and impede Darrell Smith’s federal sentencing hearing in late 2018. The scheme was uncovered by law enforcement before Darrell Smith’s sentencing.
Darrell Smith, who was found to have stolen $2.4 million from his investment clients, including $161,800 from the victim whom David Smith contacted, was sentenced to 175 months in federal prison. The court also found that Darrell Smith had obstructed justice.
David Smith, who remains released on bond, faces a possible maximum sentence of 20 years’ imprisonment, a $250,000 fine, and three years of supervised release following any imprisonment. Sentencing before Chief United States District Court Judge Leonard T. Strand will be set after a presentence report is prepared.
The case is being prosecuted by Assistant United States Attorney Timothy L. Vavricek and was investigated by the Federal Bureau of Investigation and the United States Postal Inspection Service.
