David Martinez, Possession with Intent to Distribute Methamphetamine, New Mexico 2024

Albuquerque crackled under the weight of another federal drug and gun takedown Thursday, August 6, when FBI Violent Crime Task Force agents stormed the residence of David Martinez and seized methamphetamine, firearms, and $5,133 in cash. Alongside Jean Madrid, Martinez was hauled into custody in a case that cuts to the bone of the city’s violent drug trade.

The operation began in July 2020 with a controlled buy of methamphetamine from Martinez at his Albuquerque home. That undercover move led directly to a federal search warrant. When agents moved in, they found four firearms stashed alongside meth, marijuana, and the $5,133 in U.S. currency—evidence that paints a picture of distribution, not casual use.

Martinez and Madrid now face federal charges: conspiracy to distribute controlled substances, possession with intent to distribute methamphetamine, and possession of a firearm in furtherance of a drug trafficking crime. The first two charges carry penalties of up to 20 years in prison. The firearm charge alone brings a mandatory minimum of 5 years—and a potential life sentence.

David Martinez, already a convicted felon, is additionally charged with being a felon in possession of a firearm. His 2005 record includes a guilty plea to possession with intent to distribute 5 grams or more of cocaine base and carrying a firearm in relation to a drug trafficking crime. That prior conviction could add up to 10 more years to his sentence if he’s found guilty again.

The investigation was a joint effort by the FBI’s Violent Crime Task Force and the Bernalillo County Sheriff’s Office. Assistant U.S. Attorney Louis Mattei is prosecuting the case as part of Operation Legend—a DOJ push to flood high-crime cities like Albuquerque with federal muscle to crush gun-fueled drug operations.

A criminal complaint is only an accusation. Defendants David Martinez and Jean Madrid are presumed innocent until proven guilty beyond a reasonable doubt. But in a city where bullets fly and meth floods the streets, this arrest sends a message: federal eyes are open, and the net is tightening.
