SALINA, OK – David Olice Sitsler, III, 36, will spend the next eight years in federal prison after being sentenced for a brazen act of violence in February 2022. U.S. District Judge Gregory K. Frizzell handed down a 96-month sentence Friday, followed by three years of supervised release, for three counts of Assault with a Dangerous Weapon with Intent to do Bodily Harm in Indian Country.

The incident unfolded as Sitsler argued with his wife. When she attempted to leave, seeking help from a friend, Sitsler opened fire on the vehicle as it departed. One of the passengers inside sustained injuries from the gunfire. The location of the crime places it under federal jurisdiction due to its occurrence in Indian Country.

Federal prosecutors detailed the escalating domestic dispute that culminated in the shooting. Sitsler, a citizen of the Cherokee Nation, acted with clear intent to cause harm, according to court documents. Judge Frizzell also ordered Sitsler to pay $625 in restitution to cover the costs associated with the crime.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) led the investigation, working alongside the Mayes County Sheriff’s Department. Assistant U.S. Attorney George Jiang successfully prosecuted the case, presenting evidence that secured the conviction and subsequent sentencing.

This case is being highlighted as part of the Department of Justice’s Project Safe Neighborhoods (PSN), a nationwide initiative focused on reducing violent crime and gun violence. PSN emphasizes collaboration between law enforcement agencies and community organizations to address the root causes of crime and improve neighborhood safety.

Sitsler remains in custody and will be transferred to a U.S. Bureau of Prisons facility to begin serving his sentence. The ATF continues to investigate firearms-related crimes across the Northern District of Oklahoma, working to hold perpetrators accountable and prevent future acts of violence.
