John P. Cutler, Receiving Child Pornography, New York 2024

John P. Cutler, 35, of Delevan, NY, admitted in federal court to receiving child pornography online — a crime he committed while already carrying the weight of a prior conviction for sexual abuse. The guilty plea, entered before U.S. District Judge Lawrence J. Vilardo, exposes Cutler to a mandatory minimum of 15 years in prison, up to 40 years behind bars, and a $250,000 fine.

Between July and September 26, 2016, Cutler systematically searched for and downloaded disturbing images and videos depicting the sexual exploitation of children. Federal prosecutors say he stored the material on a personal laptop. A forensic sweep of the device uncovered approximately 1,875 images and 199 video files — many showing prepubescent minors and acts of violence against them.

Cutler’s criminal history adds a darker dimension to the case. Before this federal charge, he was convicted in New York State court of Criminal Sexual Act in the Second Degree — a felony sex offense. Under federal law, that prior conviction triggers enhanced penalties for repeat offenders in child exploitation crimes.

Assistant U.S. Attorney Aaron J. Mango, prosecuting the case, emphasized the predatory nature of Cutler’s online activity. ‘This wasn’t accidental exposure,’ Mango said. ‘It was deliberate, repeated, and done with full awareness of the law.’ The investigation revealed search terms and download patterns consistent with targeted hunting for illegal content.

The probe was led by the Federal Bureau of Investigation under Acting Special Agent-in-Charge Kevin P. Lyons, alongside investigators from the Cattaraugus County Sheriff’s Office, directed by Sheriff Timothy Whitcomb. Digital evidence recovered from Cutler’s laptop formed the backbone of the case, linking him directly to the possession and receipt of the illicit files.

Sentencing is set for June 11, 2018, at 10:00 a.m. in Buffalo federal court. Cutler remains in custody pending that hearing. If sentenced to the mandatory minimum, he will spend more than a decade in federal prison — time that won’t erase the permanent scars inflicted on the children in those images.
