BECKLEY, W.Va. – A Detroit man known as ‘Dave’ has pleaded guilty to distributing deadly fentanyl in West Virginia. Daviontae Lately, 32, was arrested following a series of transactions that involved selling the deadly substance to an informant.
Court documents reveal that on September 7 and 8, 2023, Lately sold quantities of fentanyl at a residence in Beckley. Law enforcement officials subsequently executed a search warrant at the location, uncovering additional drugs and cash tied to drug trafficking activities.
The search resulted in the seizure of substantial amounts of fentanyl and cocaine base, commonly known as ‘crack,’ along with nearly $9,400, including proceeds from controlled buys involving the confidential informant. Lately admitted his intent to distribute these substances.
Lately is scheduled for sentencing on November 14, 2025, where he faces a maximum penalty of 20 years in prison, at least three years of supervised release, and a $1 million fine. United States Attorney Lisa G. Johnston praised the investigative efforts of the Beckley/Raleigh County Drug and Violent Crime Unit, which includes officers from the West Virginia State Police, the Raleigh County Sheriff’s Office, and the Beckley Police Department.
