Dr. Mason Jones and his clinic, Total Men’s Primary Care, have agreed to pay up to $600,000 in civil penalties for violating the Controlled Substances Act in Austin, Texas. The alleged violations occurred between 2023 and 2024, when the clinic and Dr. Jones failed to comply with recordkeeping requirements and electronically signed and transmitted prescriptions for a Schedule II controlled substance without a doctor/patient relationship. The DEA conducted onsite inspections of three Total Men’s Primary Care locations in Austin, Bee Cave, and Cedar Park in 2023, which led to the allegations.
The settlement resolves the allegations, and Dr. Jones has voluntarily retired fourteen certificates of registration affiliated with Total Men’s Primary Care locations. He later surrendered four additional DEA certificates of registration. Under the terms of the civil settlement agreement, Total Men’s Primary Care and Dr. Jones can satisfy their legal obligation by paying the Government $300,000 within 12 months.
U.S. Attorney for the Western District of Texas Justin R. Simmons stated that his office will hold medical providers accountable for violating patient trust and federal law. The DEA San Antonio Diversion investigators worked tirelessly to protect the public from physicians who abuse their trusted privilege.
The case highlights the importance of medical providers complying with federal law and maintaining the trust of their patients. The DEA and the U.S. Attorney’s Office will continue to investigate and prosecute those who violate the Controlled Substances Act.
