DOJ, Nursing Home Abuse, Pennsylvania 2020

WASHINGTON – U.S. Attorney David J. Freed joined Attorney General William P. Barr in announcing the launch of a national nursing home initiative, aimed at bringing to justice those who put profits over patients and commit gross abuse and neglect in nursing homes across the country.

The initiative, which is being led by the Elder Justice Initiative and the U.S. Attorneys’ Offices, will focus on identifying and prosecuting nursing homes that consistently fail to provide adequate care to their residents, including those that withhold pain medication, use physical or chemical restraints, and expose residents to unsanitary conditions.

According to Attorney General Barr, millions of seniors rely on nursing homes to provide them with quality care and dignity, but all too often, owners and operators prioritize profits over patients. ‘This national initiative will bring to justice those who have profited at the expense of their residents and ensure that residents receive the care to which they are entitled,’ he said.

U.S. Attorney Freed added that the Middle District of Pennsylvania is home to numerous nursing homes, and it is their duty to ensure that these facilities provide a safe and caring environment for seniors. ‘When they fail in that duty, or when nursing home operators commit fraud to enrich themselves at the expense of their patients and often government programs, we will be there to ensure that justice is done and our seniors are protected,’ he said.

The DOJ has already initiated investigations into approximately thirty individual nursing facilities in nine states as part of this effort. The department will consider a number of factors in identifying the most problematic nursing homes, including those that consistently fail to provide adequate nursing staff, adhere to basic protocols of hygiene and infection control, and provide residents with enough food to eat.

The Elder Justice Initiative and the U.S. Attorneys’ Offices will work together to support the efforts of state and local prosecutors, law enforcement, and other elder justice professionals to combat elder abuse, neglect, and financial exploitation. The national nursing home initiative reflects the DOJ’s larger strategy and commitment to protecting our nation’s seniors. By working together, we can ensure that seniors receive the care and dignity they deserve, and hold accountable those who prioritize profits over patients.
