NESTOR ALBERTO DURAN-ESQUIVEL, a 39-year-old citizen of El Salvador, was sentenced to 24 months in federal prison for illegal reentry, according to U.S. Attorney Dana Boente.
A federal court in Louisiana convicted DURAN-ESQUIVEL of knowingly and unlawfully re-entering the United States in Jefferson Parish without the Attorney General’s consent. The crime was committed on June 9, 2012.
The court documents revealed that DURAN-ESQUIVEL had previously been removed from the country and was subject to a previous aggravated felony conviction, which led to an enhanced sentence.
According to U.S. District Judge Helen G. Berrigan, DURAN-ESQUIVEL will serve an additional three years of supervised release following his imprisonment. During this time, he will be under federal supervision and risks an additional term of imprisonment if he violates any terms of his release.
The investigation into DURAN-ESQUIVEL’s crime was led by United States Immigration and Customs Enforcement, Enforcement and Removal Operations. The case was prosecuted by Special Assistant United States Attorney Robert Weir.
DURAN-ESQUIVEL’s sentencing is a result of a one-count indictment, which he pled guilty to on October 10, 2012. The indictment alleged that he was an alien who was previously removed and knowingly and unlawfully found in the United States without the Attorney General’s consent.
The sentencing of DURAN-ESQUIVEL serves as a warning to individuals who attempt to re-enter the country illegally, highlighting the consequences of such actions and the efforts of law enforcement agencies to combat this type of crime.
