An Orange County man has pleaded guilty to orchestrating a massive Medi-Cal fraud scheme that submitted nearly $270 million in bogus claims over an 11-month span for expensive prescription drugs containing generic ingredients that were not medically necessary, and in many instances, not provided to the purported recipients.

According to the Justice Department, Eric J. McClure, 34, of Orange County, Utah, pleaded guilty to one count of conspiracy to commit health care fraud, a felony charge that carries a maximum penalty of 20 years in prison and a $250,000 fine.

The scheme, which spanned from March 2022 to January 2023, saw McClure and his co-conspirators submit false claims to Medi-Cal for expensive prescription medications, including generic versions of brand-name drugs, that were not medically necessary and, in many cases, not provided to the purported recipients.

The scheme’s scope was massive, with McClure and his co-conspirators submitting nearly $270 million in false claims to Medi-Cal during the 11-month span.

The Justice Department’s announcement of McClure’s guilty plea marked a significant blow to the sprawling Medi-Cal fraud scheme, which had been under investigation by federal authorities for months.

McClure is scheduled to be sentenced on May 17, 2024, and faces a maximum penalty of 20 years in prison and a $250,000 fine for his role in the scheme.

The guilty plea marks a significant victory for the Justice Department, which has been working to root out healthcare fraud and bring perpetrators to justice.
