Montgomery, Alabama — A former employee of the United States Army Corps of Engineers, Dennis Fails Jr., 55, from Mobile, Alabama, has been charged with bribery for his alleged role in a scheme involving $25,000 in fake work billing. This revelation comes after an investigation by Special Agents from the United States Army Criminal Investigative Command and the Department of Defense Criminal Investigative Service.
Fails Jr. is accused of soliciting a bribe from Kenneth Hornsby, President and CEO of HCS Group P.C., which was contracted with the Corps to perform work in Peru. The indictment claims that Fails Jr. instructed Hornsby to submit fraudulent billing for work not performed, ensuring approval and splitting the proceeds.
After law enforcement intervention, Hornsby submitted the fake bill under direction, leading to Fails Jr.’s arrest at a rest stop where he was caught receiving $12,000 in cash. The defendant is presumed innocent until proven guilty beyond a reasonable doubt, but if convicted, faces up to 15 years in prison, a fine of up to $250,000, and mandatory restitution.
