Felon Caught with Firearm

A 40-year-old Wilburton man has admitted to possessing a firearm despite being a convicted felon, authorities said.

Brian Dwain Jordan, 40, of Wilburton, Oklahoma, pleaded guilty to Felon in Possession of Firearm in a courtroom in Muskogee, according to the United States Attorney’s Office for the Eastern District of Oklahoma.

The charges against Jordan stem from an investigation by the Hartshorne Police Department, the Latimer County Sheriff’s Department and the Pittsburg County Sheriff’s Department, which found that Jordan had been in possession of a firearm from June 15, 2015, to June 16, 2015, violating Title 18, United States Code, Sections 922(g)(1) and 924(a)(2).

The indictment alleged that Jordan, having been convicted of a crime punishable by imprisonment for a term exceeding one year, did knowingly possess in and affecting commerce, a firearm which had been shipped and transported in interstate commerce.

Jordan faces up to 10 years in prison and a fine of up to $250,000, according to court documents. He was ordered to remain in the custody of the United States Marshal Service pending sentencing, which will be scheduled after a presentence report is completed.

Assistant United States Attorney Chris Wilson represented the United States in the case, which was prosecuted in the United States District Court for the Eastern District of Oklahoma.

The case serves as a reminder of the consequences of firearm possession for individuals with prior felony convictions, a crime punishable by imprisonment for a term exceeding one year.
