Felons Unlawfully Possessing Firearm and Ammunition Plead Guilty
Victor Manuel Carreon, 23, of Anthony, N.M., pleaded guilty to being a felon in possession of a firearm and ammunition in Las Cruces federal court yesterday afternoon. The 23-year-old, who has been in federal custody since his arrest in September 2013, faces a maximum penalty of ten years in prison when he is sentenced.
Carreon, who was previously convicted of possession of a controlled substance and aggravated fleeing from a law enforcement officer, was arrested on state charges by Doña Ana County Sheriff’s deputies on June 19, 2013. At the time of his arrest, Carreon was found near a loaded handgun in a trash can outside a residence in Anthony.
During a post-arrest interview, Carreon admitted ownership of the handgun. His brother, Javier Orozco, 29, also of Anthony, was arrested in the vicinity of a truck parked outside the residence. Orozco allegedly had a large amount of cash and a plastic bag containing methamphetamine in his pockets at the time of his arrest.
The brothers were subsequently indicted on charges of being felons in possession of firearms and ammunition on December 11, 2013. Carreon has pleaded guilty to Count 2 of the indictment, which charges him with being a felon in possession of a firearm and ammunition. Orozco, who has pleaded not guilty to the indictment, remains in federal custody pending his trial.
The case was investigated by the Las Cruces office of the FBI and the Doña Ana County Sheriff’s Office, with assistance from the 3rd Judicial District Attorney’s Office. The case is being prosecuted by Assistant U.S. Attorney Maria Y. Armijo of the U.S. Attorney’s Las Cruces Branch Office.
Orozco has been in federal custody since his arrest in September 2013 and is presumed innocent unless he is found guilty in a court of law. The sentencing hearing for Carreon has yet to be scheduled.
