Fernando Figueroa, Methamphetamine Possession, California 2012

Fresno, Calif. – In a shocking turn of events, a local man has been sentenced to 12 years and 7 months in prison for a crime committed in self-defense. Fernando Figueroa, 39, of Fresno, was sentenced by U.S. District Judge Anthony W. Ishii for possession with intent to distribute methamphetamine.

According to court documents, the incident occurred on January 28, 2012, when three men came to Figueroa’s apartment to buy 1/8 ounce of methamphetamine. However, things took a deadly turn when two of the men began punching and kicking Figueroa as he was preparing to provide the methamphetamine. Figueroa, who claimed he was acting in self-defense, pulled a gun from his waistband and fired it once, striking and killing one of the men.

When police searched Figueroa’s apartment, they found a Ruger, Model Security Six, .357-caliber revolver loaded with six rounds of Fiocchi .357-caliber ammunition. Additionally, they discovered approximately 3.56 grams of methamphetamine, pay/owe sheets, and packaging material.

Figueroa, a previously convicted felon, will spend the next 12 years and 7 months behind bars for his crime. The sentencing is a result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Fresno Police Department, which is part of Project Safe Neighborhoods.

“This is another outstanding example of ATF and the Fresno Police Department working together to combat armed drug trafficking and violent gun crime in the City of Fresno,” said Bureau of Alcohol, Tobacco Firearms and Explosives Special Agent in Charge Joseph M. Riehl.

With Figueroa’s sentencing, the city of Fresno is one step closer to reducing the presence of armed drug trafficking and violent gun crime. The community can rest assured that law enforcement is working tirelessly to keep its citizens safe.
