A Council Bluffs man has been sentenced to 41 months in prison for a firearm offense.
Council Bluffs, IA – Garrett Duane Hanika, 33, was sentenced on Tuesday, June 29, 2021, by United States District Court Judge Rebecca Goodgame Ebinger to 41 months in prison for being a felon and a drug user in possession of a firearm. This prison term will be followed by three years of supervised release.
According to court documents, Hanika was attempting to evade law enforcement and was speeding down the center turn lanes on Broadway in Council Bluffs when he crashed the vehicle and attempted to run. Hanika was apprehended and a loaded Bryco Arms, Model 48, .380 caliber pistol was found in his car.
The Council Bluffs Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives investigated the case.
Acting United States Attorney Richard D. Westphal made the announcement.
Hanika’s sentence is a result of his reckless behavior and blatant disregard for the law. As a felon and a drug user, he was already at a disadvantage when it came to possessing a firearm. His actions put not only himself but also others at risk.
The Bureau of Alcohol, Tobacco, Firearms and Explosives and the Council Bluffs Police Department worked tirelessly to bring Hanika to justice. Their dedication to keeping our communities safe is evident in this case.
