Topsham Couple Handed Five Months in Prison for Social Security Fraud Scheme

Thomas Gerken, 63, and Jill Gerken, 62, of Topsham, Maine, have been sentenced to five months in prison for their role in a brazen Social Security fraud scheme.

According to court documents, the couple, parents to two disabled children, applied for and received Supplemental Security Income (SSI) benefits for their kids in 2004. Jill Gerken was designated as the representative payee for each child, making her responsible for using the funds for their benefit, accounting for her expenditures, and submitting information to the SSA to determine eligibility.

However, between January 2007 and July 2013, the Gerkens diverted the SSI benefits and used them to pay for personal expenses, including their mortgage, home equity loan, utilities, groceries, travel, and restaurant meals. They also failed to pay the assisted living facility where their children resided, despite Jill Gerken falsely certifying to the SSA that she spent the SSI benefits on food and housing at the facility.

U.S. District Court Chief Judge Nancy Torresen handed down the sentence, describing the Gerkens as ‘greedy’ and stating that a period of incarceration was necessary to reflect the seriousness of their offense, promote respect for the law, and provide adequate deterrence.

The SSA’s Office of Inspector General (OIG) led the investigation, with Special Agent-in-Charge Scott Antolik stating, ‘representative payee fraud is an egregious offense, not only because it involves the misuse of Social Security funds, but because it affects some of the most vulnerable members of society who cannot manage their own affairs.’

The Gerkens were also ordered to pay $98,830 in restitution. The case serves as a stark reminder of the importance of integrity and accountability in the management of Social Security funds.

The U.S. Attorney’s Office in Maine worked closely with the SSA OIG to bring the Gerkens to justice, demonstrating a commitment to upholding the integrity of Social Security’s programs and protecting its beneficiaries.

In a statement, the U.S. Attorney’s Office emphasized the gravity of the offense and the need for accountability in the management of Social Security funds.
