Gun Thief Sentenced to 5 Years Probation
A Clearfield County man has been sentenced to five years probation, the first 18 months of which must be served by conditions of home confinement, and 250 hours of community service on his conviction of violating federal firearms laws.
United States District Judge Kim R. Gibson imposed the sentence on Justin D. McElheny, 36, for his role in stealing 72 firearms, including revolvers, pistols, and rifles of various calibers, from East Coast Gun Sales from December 2007 to October 15, 2011.
According to information presented to the court, McElheny was in possession of the stolen firearms during the same time he was an unlawful user of Percocet, Oxycontin, Roxicet, and Vicodin.
The investigation into McElheny’s actions was a collaborative effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Pennsylvania State Police, and the Allegheny Township Police Department.
U.S. Attorney David J. Hickton commended the agencies involved in the investigation, stating that McElheny was prosecuted as part of Project Safe Neighborhoods, a collaborative effort to prevent, deter, and prosecute gun crime.
Assistant United States Attorney John J. Valkovci, Jr. prosecuted this case on behalf of the government.
McElheny’s sentence is a result of his conviction for violating federal firearms laws, and it serves as a reminder of the consequences of such actions.
