Waverly Man Convicted of Theft of Government Funds
A 45-year-old man from Waverly, Nebraska has been found guilty of stealing government funds.
Judge John M. Gerrard sentenced James Nieman, 45, to 5 years of probation, 12 weekends of intermittent confinement, and $272,202 in restitution. Nieman was also ordered to pay a $100 special assessment.
The theft of government funds occurred from November 2001 to March 2019, during which time Nieman received Social Security Disability Insurance (SSI) and Medicare benefits. However, he voluntarily, intentionally, and knowingly made misrepresentations regarding his employment and income to receive benefits to which he was not entitled.
The investigation revealed that Nieman received $226,737.70 in SSI benefits to which he was not entitled and $45,464.30 in Health and Human Services (HHS) benefits to which he was not otherwise entitled, totaling $272,202.00.
The Office of the Inspector General for the Social Security Administration led the investigation into Nieman’s misrepresentations, which began in November 2017 after an anonymous tip was received.
Nieman is currently serving his sentence, which includes 12 weekends of intermittent confinement and a $100 special assessment. He will also be paying $272,202 in restitution.
