A superseding indictment has been handed down in the case of Jerome Frank Brown, a 50-year-old man from Penn Hills, Pennsylvania, who faces multiple charges related to fentanyl and gun offenses.
According to the indictment, on August 19, 2021, Brown possessed with intent to distribute 400 grams or more of fentanyl, a Schedule II controlled substance. Additionally, Brown is accused of possessing a firearm after having been convicted of an offense punishable by more than one year of incarceration.
Under federal law, an individual who has been convicted of a felony is prohibited from possessing a firearm or ammunition. Brown’s alleged actions, if proven, could result in a maximum total sentence of life in prison, a fine of $10,250,000, or both.
The investigation leading to the superseding indictment was conducted by the Drug Enforcement Administration (DEA), Pittsburgh Bureau of Police, and U.S. Postal Inspectors Service (USPIS). Assistant United States Attorney Douglas C. Maloney is prosecuting the case on behalf of the government.
The indictment serves as an accusation, and Brown is presumed innocent unless and until proven guilty. A superseding indictment is a revised indictment that replaces an earlier indictment with new or additional charges.
