A Mexican man has been charged with assault with a dangerous weapon in South Dakota. According to reports, Jorge Trujillo, 21, was indicted on August 19, 2014, by a federal grand jury for Assault with a Dangerous Weapon, and Assaulting, Resisting and Impeding a Federal Officer.
The incident allegedly occurred on or about August 5, 2014, when Trujillo unlawfully assaulted a juvenile male and two women with a dangerous weapon, a knife. He also allegedly assaulted an officer while that officer was engaged in the performance of his official duties.
The maximum penalty upon conviction is a 10-year mandatory minimum, up to life, in custody and/or a $250,000 fine, 5 years of supervised release, and up to $400 to the Federal Crime Victims Fund. Restitution may also be ordered.
Trujillo appeared before U.S. Magistrate Judge John E. Simko on August 25, 2014, and pled not guilty to the Indictment. He was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set.
The investigation is being conducted by the Bureau of Indian Affairs, Standing Rock Agency. Assistant U.S. Attorney Troy R. Morley is prosecuting the case.
The charges are merely accusations and Trujillo is presumed innocent until and unless proven guilty.
According to the indictment, the alleged crimes took place in South Dakota on or about August 5, 2014. The case is ongoing, and further information will be provided as it becomes available.
